Why is this important?
OnPay works with government entities on your behalf, reporting new hires to state labor departments, calculating tax rates, paying taxes and insurance contributions, and filing financial reports. To do this effectively, you will need to authorize us to act on your behalf with tax offices for each state where your company has a tax obligation.
For example, if you operate in both Dakotas, you must complete and return a power of attorney for both states.

For OnPay to file and pay your North Dakota unemployment taxes, we must have the items listed below. Submit a request and provide the following information:
- State Unemployment Insurance Account Number

Office of State Tax Commissioner
Third-Party Access (TPA) for the North Dakota Office of State Tax commissioner
For OnPay to file and pay your North Dakota withholding taxes, we must have the items listed below. Submit a request and provide the following information:
- FEIN or SSN as registered with the State Tax Commissioner
- State Withholding Tax ID (Example: 123456789-01)
- State Withholding Letter ID (If you do not have a letter reference ID or wish to request a new letter for adding access, please let us know, as there is a box we can check to request a new letter be sent to you)
- Entity Type (i.e. LLC, Inc, Sole Proprietor)

Power of Attorney (POA) for the North Dakota Office of State Tax Commissioner
- Download the ND OSTC POA found at the bottom of this page
- Complete the top section regarding your business information
- The Taxpayer will need to sign at the bottom of the form
- Provide OnPay with a copy of your completed form
