Use custom break rules to ensure workers know what breaks they're owed, and to ensure no one missed a break they're due. You can even set up a waver for when they elect to miss a break, so it's automatically documented each time an employee postpones or skips a break.
Add a custom break rule
Go to Time Tracking> Settings.
Click Add Break Rule.
Basics
Select "Meal" for an unpaid break (time on break is not included in wage and overtime calculations), or "Rest" for a paid break (time on break is included in calculations).
Give this break a name and a description to make it easy to distinguish from other breaks.
Enter a minimum time for this break, and select whether this time is "forced" or "not forced". In the below example, employees will be unable to end this break until 10 minutes after they've started it. If you want employees to be able to return from break earlier, select "Not Forced".
Once you've set up the basics of this rule, click Continue.
Tracking
Tracking lets you decide how long an employee can be on the clock before they have to take a break. If a break isn't taken within that time frame, it's automatically documented as "missed".
If you have a worksite in a state or district with local break laws, select Track. If this isn't necessary, select Do Not Track.
Track missed breaks
If you select Track, you'll see two additional sections: Break Wavers, and Custom Intervals.
Break waivers
Custom waiver text
If you select Allow Waiver, you can select Use Custom Text to draft your own custom waiver that complies with your local laws and guidelines.
You can also select Use Default Text to use the waiver we've provided for you.
IMPORTANT: Not legal advice
The default waver text is not intended to cover all compliance laws in every state. We strongly recommend consulting with qualified legal counsel before implementing any break waiver. OnPay expressly disclaims any liability, penalties, damages, or legal claims resulting from your use of the default waiver text.
Custom intervals
Break intervals let you set how long an employee can work before a break is required. You can select "Basic Intervals", or create your own "Custom Intervals".
Basic Intervals
Basic Intervals gives you one required frequency, with the option for one threshold. In the below example, a break must be taken every four hours, but not before working two hours.
Custom Intervals
Custom Intervals lets you stage tiered break frequencies throughout a given shift, with thresholds for tracking and waivability. You can add and delete these break tiers as needed.
In this example, the first break must be taken in the first four hours of the shift, but not before working two hours. This break can be waived if missed or taken late, but not after the fifth hour. After the sixth hour, another break is required, which is waivable until the ninth hour.
Click Create to save your custom break rule.
You can view and edit your break rules and add more in Time Tracking Settings, and they'll be avaiable to select when adding a Time Clock to a worksite.
IMPORTANT:
Workers are not able to clock in until a time clock is added to their worksite.
